What kind of judge tells a defense attorney that he cannot put on a defense of his client?    (Dec. 3, 2012) — The Post & Email has learned that following a trial which lasted approximately seven hours, a jury in Monroe County, TN voted to convict Walter Francis Fitzpatrick, III of “tampering with government records.”   However, Judge Walter C. Kurtz did not allow Fitzpatrick’s defense attorney, Van Irion, to present either of two defense strategies he had prepared.  An eyewitness informed The Post & Email that only the prosecution’s side was heard.   LINKhttp://thejaghunter.wordpress.com

     I have been keeping everyone updated on Montgomery Blair Sibley's case.  For those who might have missed any updates, Montgomery is an attorney. A very politically smart attorney. He represented the "DC Madame" who was murdered to shut her up. That poor woman "hung" herself, or so the official story goes. The Blair House, residence of the Vice President, was named in honor of Montgomery's family.
     His case is very important. The sheer amount of legal work he's done is staggering and Montgomery isn't giving up.  I would encourage radio talk show hosts to book him on their show to talk about his case. Many States Balk At Setting Up ObamaCare Insurance Exchanges     Those who thought ObamaCare was set in concrete by Chief Justice John Roberts' decision last June are in for a shock.  Dec. 14 is the new deadline (extended from Nov. 16) for states to let the feds know, yea or nay, whether or not they will be setting up a health insurance exchange, which is the key to participating in the misnamed Patient Protection and Affordable Care Act.
     Obama's belief that the public would warm up to his signature legislation once it became the law of the land has proved false. The current Kaiser Family Foundation poll reports that only 38% of the public approves of ObamaCare.
     Sixteen states, including Virginia, Wisconsin, Ohio and Missouri, have told the feds they are declining to play ball. They have given notice to the federal government that they are refusing to set up a health exchange, which means it falls to the federal government to set up exchanges for those states.
     Only 17 states have committed to set up health exchanges as ObamaCare expected, while the other states are still wrestling with their decision. Republicans and Tea Partyers are encouraging them not to set up an exchange.

The FDA is definitely not a fan of free speech.
     A cherry producer who cites peer-reviewed scientific research from prestigious universities on the health benefits of cherries would, in FDA-speak, have engaged in “false” and actionable “misbranding” which suddenly turns the cherries into what FDA calls “drugs.” It’s because of this “misbranding” threat that supplement producers are not allowed to discuss scientific research on the efficacy of their products.   LINK

TSA Seeks Permission to Conduct “Security Assessments” on Highways Greasing the skids for airport-style pat downs on the interstate  Paul Joseph Watson  
   The TSA is seeking permission from the Office of Management and Budget to conduct “security assessments” on highways as well as at 140 other public transportation hubs, including bus depots and train stations.
   The request was buried amidst a deluge of jargon and published in the Federal Register on November 30.
   If approved, it would allow the TSA to to “conduct transportation security-related assessments during site visits with security and operating officials of surface transportation entities.”
   “Similarly, TSA wants to conduct on-site assessments with public agencies that run buses, rail transit, long-distance rail and less common types of service, such as cable cars, inclined planes, funiculars and automated guide way systems,” reports Government Security News.
   On the face of it, the “security assessments” involve TSA officials telling transportation organizations what security measures they should adopt as part of the Highway Baseline Assessment for Security Enhancement (BASE) Program. It doesn’t take a genius to figure out what measures the TSA is likely to recommend – more “security assessments” that require more TSA agents and more funding for the federal agency.   LINK

     President Obama’s bid to control what your children learn in school is surely one of the most important and disturbing of his many transformative plans. Not only is Obama’s attempt to devise what is in effect a national K–12 school curriculum arguably unconstitutional and illegal, the fact that most Americans have no idea that the new “Common Core” (a.k.a. Obamacore) even exists may be the most troubling thing about it.
     Today’s Washington Post features an article on the controversy being kicked up by the new English curriculum that 46 states and the District of Columbia are just now waking up to. Not coincidentally, this new education war is hitting less than a month after Obama’s re-election, just in time to prevent the public from taking the most effective step it could have to block the changes. You have to get nearly to the end of today’s Post article even to get a hint of the fact that Obama is the real force behind the new curriculum. Following that link takes you to an article that more frankly lays out Obama’s role in commandeering the substance of what’s taught in the nation’s schools. The print version of this September 21, 2012 article featured a more revealing headline than the web version: “Education overhaul largely bypasses Congress.”
     To say the least, the legality of Obama’s curriculum power-grab is dubious, as George Will explains.
The trouble with the new English curriculum is that it largely crowds out classic literature in favor of non-fiction. As teachers and students rebel against boring selections and the gutting of their most popular units, defenders of the Common Core claim that schools have missed qualifications in the new requirements (helpfully laid out in an obscure footnote).
     Technically, the new non-fiction requirements can be satisfied in classes other than English. In practice, however, with science teachers unwilling to assign essays, English classes are forced to junk Huckleberry Finn in favor of readings such as “Executive Order 13423: Strengthening Federal Environmental, Energy, and Transportation Management.” The potential for political abuse in a curriculum heavy with government documents and news articles should be obvious. Given the politics of most teachers, the new non-fiction requirements create a huge opening for leftist indoctrination. And that’s only the beginning of the potential political abuses of the Common Core.
     That 45 states and the District of Columbia have signed on to what is in effect becoming a new national curriculum, most of them without even seeing the new standards, is a Constitutional, legal, political, and educational outrage. Obama is most at fault, yet the states (many run by Republicans) also deserve blame for selling their constitutional birthright for a mess of pottage. I have much more to say about the Common Core here.
